Se determinó que en el presente asunto no hay conflicto de competencia, toda vez que en realidad no se trata de una colisión de competencias porque ésta no se ha suscitado entre los Jueces de la referencia.
Se trata de un fallo de tutela que como toda sentencia de tutela está sujeta a su eventual revisión.
En el presente caso hubo un fallo en primera instancia.
Necesariamente tenía que haberse dictado la sentencia de fondo porque en la tutela no tienen cabida las sentencias inhibitorias.
En consecuencia, se ordenó remitir el expediente de la tutela instaurada a la respectiva Sala de Selección para que sea allí donde se determine si se escoge o no para revisión.
